1. License Grant

The developer grants the user a non-exclusive, non-transferable license to install and use the software AstroIndexer.

The purchased license tier determines which features of the software are available:

• Standard – All core features (Gallery, Index, Statistics, Data View, Catalogue, Equipment Manager, Planner, Sky Map, Tools).
• Professional – All Standard features plus Quality Analysis, Imaging Intelligence, Photometry, and custom equipment profiles.

2. Installation and Use

The software may be installed and used on up to 3 devices belonging to the same user.

The software may be used for personal astrophotography workflows.

3. Restrictions

You may not:

• Copy, redistribute, or resell the software.
• Reverse engineer, decompile, or modify the source code.
• Share license keys with third parties.
• Use the software on more than 3 devices simultaneously.

4. Ownership

All intellectual property rights in the software remain with the developer. The software is licensed, not sold.

5. Updates

Updates may be provided at the developer's discretion. There is no entitlement to future updates or new features.

6. Disclaimer of Warranty

The software is provided "as is", without warranty for specific results or uninterrupted operation.

7. Limitation of Liability

Liability is limited to the purchase price of the software, to the extent permitted by law. Cases of intent or gross negligence are excluded from this limitation.

8. Termination

This license is granted for an indefinite period. The developer may terminate the license if the user violates the terms of this agreement. Upon termination, the user must remove all copies of the software.

9. Governing Law

This license agreement is governed by the laws of the Federal Republic of Germany. The place of jurisdiction is, to the extent permitted by law, the registered office of the developer.

Der Entwickler gewährt dem Nutzer eine nicht-exklusive, nicht übertragbare Lizenz zur Installation und Nutzung der Software AstroIndexer.

Die erworbene Lizenzstufe bestimmt, welche Funktionen der Software zur Verfügung stehen:

• Standard – Alle Kernfunktionen (Galerie, Index, Statistiken, Datenansicht, Katalog, Equipment-Manager, Planner, Himmelskarte, Tools).
• Professional – Alle Standard-Funktionen sowie Qualitätsanalyse, Bild-Intelligenz, Photometrie und benutzerdefinierte Equipment-Profile.

2. Installation und Nutzung

Die Software darf auf bis zu 3 Geräten installiert und genutzt werden, die demselben Nutzer gehören.

Die Software darf für persönliche Astrofotografie-Workflows genutzt werden.

3. Einschränkungen

Es ist nicht erlaubt:

• Die Software zu kopieren, weiterzugeben oder weiterzuverkaufen.
• Reverse Engineering, Dekompilierung oder Modifikation des Quellcodes durchzuführen.
• Lizenzschlüssel an Dritte weiterzugeben.
• Die Software auf mehr als 3 Geräten gleichzeitig zu nutzen.

4. Eigentum

Alle geistigen Eigentumsrechte an der Software verbleiben beim Entwickler. Die Software wird lizenziert, nicht verkauft.

5. Updates

Updates können nach Ermessen des Entwicklers bereitgestellt werden. Ein Anspruch auf zukünftige Updates oder neue Funktionen besteht nicht.

6. Gewährleistungsausschluss

Die Software wird „wie besehen“ bereitgestellt, ohne Gewähr für bestimmte Ergebnisse oder ununterbrochenen Betrieb.

7. Haftungsbeschränkung

Die Haftung ist auf den Kaufpreis der Software begrenzt, sofern gesetzlich zulässig. Ausgenommen sind Fälle von Vorsatz oder grober Fahrlässigkeit.

8. Kündigung

Diese Lizenz gilt auf unbestimmte Zeit. Der Entwickler kann die Lizenz kündigen, wenn der Nutzer gegen die Bedingungen dieses Vertrags verstößt. Bei Kündigung muss der Nutzer alle Kopien der Software entfernen.

9. Anwendbares Recht

Dieser Lizenzvertrag unterliegt dem Recht der Bundesrepublik Deutschland. Gerichtsstand ist, soweit gesetzlich zulässig, der Sitz des Entwicklers.
